SmartShell QuickStart Guide

The TurboPatent SmartShell uses automation to assist you in generating Office action response shells. It eliminates many of the tedious processes, allowing you to focus on only the important aspects. It also provides strategic, actionable intelligence at exactly the right time.

SmartShell produces a package that includes:

  • Office Action Shell (Word) containing:
    • Bibliographic data as header
    • Issues identified by statute, claims affected, and citations
    • Claims with rolled over status indicators and “cleaned” markup
  • TurboPatent Office Action Report – includes examiner, art unit and class statistics
  • Client Summary Letter (Word)
  • OCR Converted Office Action (PDF) – with text layer added for copy/paste
  • OCR Converted Previous Claims (Word), if applicable

To use SmartShell, navigate to [firm domain] in your browser (supported on Google Chrome. Microsoft IE not supported at this time). Simply enter the application number (published applications) or drop the Office action PDF as provided from the USPTO into the Office action upload box to get started.

If you entered an application number, SmartShell will verify that it is analyzing the most recent Office action. Simply click “Yes” to verify that it’s the most recent.

SmartShell processes the Office action and and presents the bibliographic information. Check the information for completeness and edit if necessary. Then click “Review issues” or the right arrow.

SmartShell automatically identifies the examiner’s issues to represent in the shell. Simply scroll through Office action on the screen to see the highlighted issues.

To add an additional issue, click the “Add new issue” button at the upper right and then highlight the issue statement you would like to add.

To modify or remove an existing issue, simply click the red gear icon next to that issue, select modify issue, or remove issue and follow the prompts. When modifying an issue, be sure to select all of the text that represents the issue statement.

Once you have completed reviewing the Office action issues, click “Add claims”

SmartShell automatically “rolls over” the claims to prepare them for the response and possible amendments. It updates the status indicators and cleans any markup.
Drag and drop a Microsoft Word file with the most recent claims into the file upload box. The claims can be a stand-alone document or as part of a previous Office action response. If you do not have a set of claims in Word, click “Help” and SmartShell will help generate a Word file from the Claims in PAIR. Otherwise, click “skip” and you can manually add the claims at a later time.

If you asked TurboPatent to help you retrieve the claims, click “fetch claims” and TurboPatent will OCR the most recent set of claims available on Public PAIR. If the application is not published or if SmartShell is unable to fetch the most recent claims, download the claims from PAIR and drop the document (PDF) on the dropzone.

Once the converted claims (Word) are available, download and open the file to check for accuracy. Although SmartShell uses state of the art OCR techniques, there may be some errors. If so, correct those errors, and ensure proper formatting, then save the Word file and drop the file into the upload box.

After you have uploaded the claims, SmartShell will let you know that they have been successfully uploaded.

SmartShell comes with default templates, but can be configured to output into custom Word templates*. Select the appropriate template and click “Generate Shell” and that’s it. SmartShell immediately downloads the SmartShell package to your system.

* Custom templates require a one-time process by TurboPatent. Contact TurboPatent ( to have SmartShell output to your custom template(s).
